What Is Guardianship?

A guardian is a court-appointed person with the right to make decisions for someone who is unable to make legal, financial, or medical decisions for themselves. Both children and adults may be placed under a Florida guardianship. It is most often established for a minor child who requires a guardian of the minor’s property or for an incapacitated person who lacks the capacity to manage some or all of their own affairs.

Guardianship in Estate Planning

If you have minor children, or you are named the guardian of a dependent adult, it is in your best interest to name a guardian for them in your estate plan. Under Florida law, if a child’s parents die or become incapacitated, they must have a guardian appointed. Naming one in your estate plans allows you to have control over who will care for your children if you are incapacitated or pass away.  It is important to note that the Florida Courts and Legislature strive to use the least restrictive form of guardianship or less restrictive alternatives, when they are available. If you are naming a potential guardian for a dependent adult, you may be able to dictate whether they should receive plenary (full) or limited powers of guardianship.
