¿Qué es una “Expresión de una idea” y “Fija en un Medio Tangible”?

Aunque el smartphone es un “medio tangible” según la definición de derechos de autor, no es una “expresión de una idea” – es un objeto útil y funcional. Ahora bien, si coges ese mismo objeto del smartphone, y lo trasladas a una galería de arte, y lo exhibes como una obra de arte, ese objeto del smartphone se convierte en la expresión de una idea fijada en un medio tangible. La expresión de la idea, siendo la intención del artista – el propósito del artista al crear esa obra. Si suponemos que la obra se llama “pos pos pos modernismo”; pues esa sería la expresión. El medio tangible es entonces el smartphone. Esa conversión es suficiente para cambiar la naturaleza del smartphone, de un objeto útil a la expresión de una idea. Esa obra, “pos pos pos modernismo”, sería protegible por los derechos de autor. Pero únicamente la obra, y no los elementos útiles del smartphone que inspiró la obra.

Para concluir, cabe reiterar que el objeto o proceso de diseño, al ser util, se rige por el régimen de patentes. No obstante, las expresiones preliminares de ese objeto (sketches, modelos, notas) en la medida que sean expresiones de ideas, pertenecen al régimen de derechos de autor; pero únicamente protegen esa expresión, y no el objeto de diseño.

En adición, expresiones artísticas fijadas en el objeto final de diseño, que no tienen componente funcional, como por ejemplo un dibujo en una lata de soda o la etiqueta de un empaque de jabón, se rigen por los derechos de autor. Entonces en ese caso existirían en el mismo un objeto de diseño componentes funcionales protegidos por patentes, y componentes expresivos protegidos por derechos de autor.
